He's Your "Hubby" on Facebook, But a Stranger in Court
We get it. You’ve been together since the invention of the iPhone. You finish each other’s sandwiches. You call him "the Hubs" on Instagram, and he calls you "the Wifey." Your grandma thinks you’re married. The mailman thinks you’re married. But Jos Family Law is here to be the bearer of awkward news: The State of California thinks you are single. And frankly, the State is the only opinion that matters when you break up.
Here is the deal with California Common Law Marriage: It is a ghost story. It doesn't exist. You can act married until you are blue in the face. You can wear matching rings. You can check into hotels as Mr. and Mrs. Smith. But unless you went to the clerk’s office, paid the fee, and said "I do" in front of someone with the power to make it stick, you are legally strangers. You are essentially two people who just happen to have the same Netflix password.
Why does this matter? Because strangers don't get alimony. Strangers don't get half the house. Strangers don't inherit your pension if you die without a will. Relying on the "holding out" theory—the idea that if you fake it long enough, you make it—is a financial disaster waiting to happen. You are essentially volunteering for all the hard work of marriage (laundry, in-laws, compromise) with absolutely none of the legal benefits. You are paying the premiums without the insurance policy.
It’s harsh, but it’s true. The law loves paperwork. It hates ambiguity. So, if you want the rights of a spouse, you have to do the paperwork. Go to City Hall. Get the license. Or, at the very least, sign a Cohabitation Agreement that gives you some contract rights. Stop pretending and start protecting yourself.
